COUNCIL MEETING MINUTES 03-08-10

The meeting of the Council of the Village of Chagrin Falls was called to order at 8:00 p.m. by Mr. Patton.

Member present: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams
Members absent: None.
Officials present: Mayor Brick, Himes, Zugan, Brosius, Byron, Lannon

APPROVAL OF MINUTES

Moved by Mr. Williams, seconded by Mrs. Evans that the minutes of the meeting held February 22, 2010 be approved. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams. Nays: None.

REPORT OF THE MAYOR

Mayor Brick said he hopes everyone has received the copy of the 2009 report from the Economic Advisory Board. The Board would appreciate any comments or suggestions you have. It is a collection of data along various parameters with respect to things that are going on in the Village.
Mayor Brick said he is very pleased to share with everyone the information that the Ohio EPA has awarded Chagrin Falls a certificate recognizing the successful efforts of our water department that they have taken to ensure the quality of the drinking water.

Mayor Brick said the next Village shredding event will be held on Saturday, April 24, 2010, from 9:00 a.m. to 12:00 p.m. at the Chagrin Falls intermediate school parking lot on Philomethian Street.

REPORT OF THE LAW DIRECTOR

SECTION 137.08 AMENDED
Mr. Byron placed on the floor Ordinance No. 2010-08 entitled:


AN ORDINANCE AMENDING SECTION 137.08 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF CHAGRIN FALLS RELATING TO THE REVIEW OF PLANS BY THE ARCHITECTURAL BOARD OF REVIEW.

Mr. Jacobs said these are just modifications to the architectural review process. He said it will remain on readings until April 12, 2010.

CERTAIN SUBSECTIONS OF 1109.05 AMENDED
Mr. Byron placed on the floor Ordinance No. 2010-09 entitled:

AN ORDINANCE AMENDING CERTAIN SUBSECTIONS OF 1109.05 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF CHAGRIN FALLS RELATING TO ARCHITECTURAL BOARD OF REVIEW PROCEDURES.

Mr. Byron announced a public hearing for Monday, April 12, 2010.

NEW CHAPTER 1115 ENACTED
Mr. Byron placed on the floor Ordinance No. 2010-10 entitled:

AN ORDINANCE ENACTING NEW CHAPTER 1115, DESIGN REVIEW, TO PROVIDE FOR DESIGN REVIEW REGULATIONS THAT MAINTAIN AND ENHANCE THE DISTINCTIVE CHARACTER OF THE VILLAGE.

Mr. Byron announced a public hearing for Monday, April 12, 2010.

AUTHORIZATION TO ENTER INTO AN AGREEMENT WITH THE BOARD OF COUNTY COMMISSIONERS AND C.R.I.S.
Mrs. Lutz introduced Ordinance No. 2010-11 entitled:

AN EMERGENCY ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE BOARD OF COUNTY COMMISSIONERS OF CUYAHOGA COUNTY, OHIO, AND THE CUYAHOGA REGIONAL INFORMATIONAL SYSTEM BOARD OF ADVISORS (C.R.I.S.) IN ORDER TO CONTINUE THE PRESENT SERVICE AGREEMENT WITH AMENDMENTS.

Moved by Mrs. Lutz, seconded by Mrs. Evans that the requirement for reading an ordinance three times be suspended. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams. Nays: None. Moved by Mrs. Lutz, seconded by Mr. Williams that the ordinance be adopted. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams. Nays: None. Mrs. Lutz said they plan to re-subscribe to this service. It allows them to tap into a central data base of criminal information, which is essential for the police department to do their job properly. There is no increase over 2010. Chief Brosius said it is about one thousand dollars per month.

FINAL ORDER OF COUNCIL AND CONCLUSIONS OF FACT - 232 CHAGRIN BLVD.
Mr. Williams introduced Administrative Order No. 2010-12 entitled:

FINAL ORDER OF COUNCIL AND CONCLUSIONS OF FACT REGARDING A VARIANCE REQUEST OF JOANN MITCHELL FOR PROPERTY LOCATED AT 232 CHAGRIN BOULEVARD.

Moved by Mr. Williams, seconded by Mrs. Evans that the administrative order be adopted. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams. Nays: None. Mr. Williams explained the specifics of the variance request. He said the BZA voted unanimously to approve the variance request.

Mr. Patton announced a meeting for Thursday, March 18, 2010 at 6:00 p.m.

Mr. Patton acknowledged that Council did receive the monthly expenditure reports as well as the monthly statement of cash receipts and disbursements for February, 2010.

Mrs. Evans reported that the Commission reviewed their budget needs for the coming year.

Chief Brosius reported that the annual Your Life... Your Choice Program will be held on April 27, 2010 at Parkside Church.

MEMBERS OF THE PUBLIC TO SPEAK TO ANY MATTER (NOT TO EXCEED FIVE (5) MINUTES)


Mario Piano of the Chagrin Valley Jaycees requested permission to hold the 55th annual Blossom Time Festival from May 27, 2010 through May 31, 2010. Pete Moisis of the Chagrin Valley Jaycees requested permission to extend the hours of the festival from 10:00 p.m. to 11:00 p.m. on Friday, Saturday, and Sunday. There are two concerns; the Orange Street residents and the police department’s opinion. There was lengthy discussion, comments were heard, and questions were answered. Chief Brosius said extending the festival one hour won’t be an issue for the police department. Mr. Patton said next year the Jaycees should poll the Orange Street residents and get their opinion before they come to Council for approval.

Moved by Mr. Patton, seconded by Mr. Milko that we permit the Jaycees to use Riverside Park for Blossom Time between May 27, 2010 and May 31, 2010 and that, at least for this year, we permit them to use the park until 11:00 p.m. subject to the police monitoring that and subject to the cooperation between the Jaycees and the police department in honoring any requests that the Chagrin Falls police may have. I would also ask that if you come back next year and ask to stay open until 11:00 p.m., if you could maybe provide us some input from the residents so we can take that into consideration. Mr. Williams said a modification to your motion is that we limit the 11:00 p.m. extension to the Friday, Saturday, and Sunday nights, which are the 28th, 29th, and 30th and, of course, they shut down early on Monday anyway. Mr. Patton said they don’t open on Monday. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams. Nays: None.

Mr. Moisis also explained that they would like to have en evening parade from Spillway to Vincent Street to Bell Street to Main Street, between 9:00 p.m. and 10:00 p.m. on Saturday night with a limit of one dozen illuminated floats. Mr. Patton said they will have to get back to the Jaycees in a couple of weeks on the evening parade.

Mr. Moisis requested permission to hold the annual Taste of Chagrin on Saturday, May 29, 2010 and Sunday, May 30, 2010 on North Franklin Street until 11:00 p.m.

Moved by Mr. Patton, seconded by Mr. Milko that we permit the Jaycees to have the Taste of Chagrin again in the Village for two days as stated by Pete and that we permit it this year to be extended until 11:00 p.m. on Saturday and Sunday. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams. Nays: None.

MISCELLANEOUS

Mr. Subel asked if the District One Public Works Integrated Committee recommended projects and 2010 funding should be going through Council? Mr. Himes said yes. Every year we apply for OPWC funds for various projects around the Village. We have applied for Solon Road, North Street, and various other roadway projects. This year we have applied for the Solon Road water main and generator improvements and were granted those two so we will be preparing legislation for Council to authorize those projects.
