The meeting was called to order at 7:30 p.m. by Chairman Nancy Rogoff.

The minutes of the meeting held August 17, 2009 were approved.

32 WEST ORANGE STREET - RESIDENTIAL MIXED USE OVERLAY

Mr. Himes explained that this property is owned by the Village and has been used for office purposes and is zoned “Office District”. He said Larry Shibley is unable to perform his end of the contract with the Village to redevelop the land on West Orange Street so Robert Vitt has submitted a plan to the Village for the redevelopment of this parcel and adjoining parcels of land. This redevelopment plan proposes a residential use on the subject property and the Village desires to amend the Zoning Map to provide for Residential Mixed Use zoning on the subject property, which zoning shall overlay the Office District zoning, allowing users pursuant to either chapter of the zoning code. Mr. Himes explained the extensive background of this area on West Orange Street. He said this was referred to the Planning and Zoning Commission for their recommendation. There was lengthy discussion including variances and parking issues. No action was taken.

REVIEW AND APPROVAL PROCEDURES - CHAPTER 1109.05

Mr. Himes said he did speak with the ARB but he has not heard anything back from them. Revision #2, dated September 10, 2009, was discussed. Comments were heard and revisions were suggested.

DESIGN REVIEW - CHAPTER 1199

Draft #1, dated September 10, 2009, Clarification of Preliminary Review, was discussed. Comments were heard and revisions were suggested.

The meeting adjourned at 8:50 p.m.
